An apostille is considered as a statutory Stamp permitting the use of documents overseas, including personal and corporate documents.
It requires several authentications by particular governmental officials to obtain the Apostille Stamp.

So, how to obtain Apostille services?

Grasping this concept could be challenging with all legal operations requested by each agency to get its verification, especially for individuals who wanted to certify no further than personal papers such as birth & death certificates, marriage certificates, divorce decrees.

Apostille services can be used only for documents issued in a country party to the Apostille Convention.

Apostille & Notary

A notary is a different term than Apostille; as we discussed above, an apostille stamp is made to facilitate the use of your documentations in other countries.

Notarization from the State Notary Public is required in order to use the documents in the United States of America.

Therefore, we can say that the apostille stamp gives you international services overseas. On the other hand, Notarization gives you local authority to use the documents within the U.S.A.

To apostille most documents, a Notary signature and a seal is required.

Can you use the apostille stamp in a country that isn’t in the Convention?

No. But of course, you can use the document abroad in a non-participating country if you fulfilled the required actions by the embassy of the country where you wish to use the document.

Usually, each embassy has its own terms and conditions.

You can have a glimpse of apostille convention participating countries here.

What is the difference between Apostille and authentication (legalization)?

On the other token, several countries aren’t taking part in this Convention, and to use any document in there, you will need to get it legalized first.

The core difference between the two sides is plain:

e.g., if I would like to use my Driving license abroad

The first case of non-participating countries such as Kuwait,

I will need first to authenticate my license from the Secretary of State,

then move to the U.S. Department of State to get their authentication as well and finally go to the Kuwait embassy and follow their directions to use my license in their country.

Moreover, each embassy has its own conditions.

Case (2)

For a participating country like Germany,

All I need to do in this case is to go to the Secretary of my state and obtain the apostille seal attestation on my notarized driving license, and I can have a ride in Germany, that’s it. Easy.

That’s the significant difference between both of the sides.

Here are some documents you may have the Apostille on:

  • Circuit Court documents.
  • Birth and death documents.
  • School transcripts.
  • Marriage and divorce certificates.
  • State criminal background checks.
  • Power of attorney.
  • Certificate of existence
  • Certificate of Incumbency
  • Patent Assignment
  • Trademark Assignment
  • Technical Data Sheet
  • Certificate of Free Sale
  • Certificate of Analysis
  • an ISO Certificate,

Requirements for each state may diverge slightly; however, the core factors are roughly the same.

Let’s take two states as an example

Florida, which calls for Alabama’s same demands, the whole variation is fees per documents and handling time.

Nearly all states require the following:

  • Notarized document (if required depending on the type of document).
  • A cover letter contains; your name, address, name of the country where you wish to use your documents, and an e-mail address.
  • A self-addressed envelope for the return & a prepaid airbill if you wish to use express mail.
  • A check or money order payable to the Secretary of State.

Most of the time, all Secretary of State require the same points mentioned above.

As we agreed previously in this article, we won’t focus on a particular State; but rather, we’ll concentrate on document requirements and specifications generally in the United States.

Most Secretaries of States classify the document as follows:

1)        Public document.

  • Vital records.
  • Other governmental-issued documents.

2)        Corporate document.

3)        Federal issued document.

Essentially, those are the three key documents eligible for authentication.

First, let’s discuss the vital records:

Those are documents such as Birth, death, and marriage certificates.

Vital records document doesn’t need any authorization from State Notary public. Just ensure that vital record registrar signs the certificate, after that you may forward the certificate to Secretary of your state in order to be apostilled.

Second, other personal documents:

State Notary Public must notarize document such as a power of attorney; then, you may forward the document to the Secretary of State.

Third, corporate document:

As we discussed previously, corporate documents must be notarized by Notary public then  forwarded to the Secretary of State.

Forth, Federal document:

Secretaries of State don’t authorize federal document; you will need to forward them directely to US Department of State for authentication.

Note** some secretaies of state require that the document must be authenticated by county officials first then forwarded to the Secretary of State.

Can anyone get your documents apostilled for you?

Yes. You can find several agencies providing international apostille services near you to help you in the authentication process.

However, you must choose a trusted agency to authenticate your documents, whether corporate or personal documents; definitely, they must be of high importance for you. Hence, you need insurance that your documents are in safe hands.

And will be processed on time.

What kind of guarantees should you consider?

  • Previous experience with recognized and trusted clients.
  • Operating time of the agency, often really important, as long as they have a glorious history in the authentication field.
  • It means a lot to rank on google, So, you may have a look on that as well.
  • Got an actual office in the U.S.A.
